In the transparency and accountability category, Malawi obtained high scores (100) in indicators #2,#3, and #4. For

indicator #3, the general perception is that there is a transparent appointment process of the judges in the highest

courts in Malawi (High Court and Supreme Court of Appeal) which follows a merit-based selection criteria and that

judges enjoys a security of tenure as the president cannot remove them from office. For indicator #4, judgements from

the High Court and the Supreme Court of Appeal are made in references to the laws or jurisprudence they considered

and the specific interpretation they gave in relation to the case. Also, court rulings become public documents that are

accessible to anyone who request them through registries. The challenge, though, is that not all citizens are aware that

they can request court rulings for free from the judiciary
